If the guest cancels 30-60 days before the start of the stay, they will receive a 50% refund. If they cancel within 30 days of the start of the stay, no refund will be given.

If your reservation start date falls on any holiday listed you will need to rebook your check-in date. Thanksgiving Day, Christmas Day, New Years Day, Easter Day, Memorial Day, 4th of July, & Labor Day. ***Heating the pool for your visit is optional, and is an additional $50/night. Please let us know at least 48 hours in advance if you would like to choose this option! PARTIES AND NOISE: Amplified music is not allowed outside the unit. Tenant agrees not to bring speakers outside and to not crank up the music playing inside so it can be also heard outside. No party or event may take place without prior written permission. For the purposes of this rental agreement, all parts will consider that there is a party inside the unit whenever the number of daytime occupants in the unit exceeds the maximum number of eight (8) daytime occupants for this unit. UPDATE 5/28/20: DUE TO RIVERSIDE COUNTY AND CITY OF PALM SPRINGS WIDE COVID-19 MANDATES, NO ADDITIONAL DAY GUESTS ARE ALLOWED AT THIS TIME. Only guests booked and on contract for the reservation may be in this home. Notwithstanding the former prevision, even if the maximum number of daytime occupants is not exceeded, all other common definitions of a party will be accepted, whenever the noise level inside the unit is beyond what is reasonable accepted as normal. In the event that a non-authorized party or event takes place at the unit, Tenant risks forfeiting up to the entire security deposit in addition to any costs associated with legal remedies that may be necessary. Tenant agrees to keep the noise level inside the house under respectable levels, so as to not interfere with the peace and quiet of any person outside the boundaries of the property. Tenant agrees to conform to all provisions and city ordinances per the relevant Municipal Code. Failure of Tenant to adhere to City regulations will be considered a breach of this rental agreement. Tenant hereby authorizes the Manager to make charges to the Tenant's credit card in file for up to $1,500 per incident, should any complaint about the noise level inside the house arise with the local police or the local city authorities. Furthermore, Tenant recognizes the right of the manager to ask Tenant and Tenant's guests to vacate the unit immediately if it becomes necessary without a refund of the rental amount. ADDITIONAL OCCUPANTS: If more than the agreed number of overnight occupants as described in the Reservation Summary spend the night at the Unit, or more than double the maximum number of overnight occupants as described in the Units website are at any given time inside the unit, Tenant risks forfeiting part or all of the security deposit. SMOKING: Absolutely NO SMOKING INSIDE. Tenant risks forfeiting their security deposit in addition to any associated cleaning costs. A minimum charge of $250 will apply per reported incident. FILMING: The filming of any still or motion pictures in any format that requires more than 2 persons and/or any specialized gear, apparatus or crew is strictly prohibited unless prior written authorization is obtained. Failure to obtain written authorization may result in full deposit forfeiture. PETS: Dogs are allowed with an additional non-refundable PET FEE and only with PRIOR WRITTEN approval. Your dog must be well behaved. All dog waste must be disposed off in the outdoor garbage cans. Any and all damages will be charged to the booking guest. SECURITY DEPOSIT: The security deposit is in addition to the rental amount. The amount returned is also conditional upon all terms of this agreement being met (examples include but are not limited to: violations of our non smoking policy, violations of our no party policy). Tenant is liable for all replacements and repairs that are outside what is considered normal wear and tear and will be taken from their deposit. CHECK IN: Unless agreed differently by the Manager in writing, check-in is any time after 3:00 PM. Manager will send Tenant the instructions for a self check-in in advance, or keys or and entry-code will be provided at property location upon check-in. Keys will not be issued with a balance owing or without a signed rental agreement in the owners, or owner's representatives, possession. Once Tenant has checked into the unit or he/she has been granted access, Tenant accepts the condition, size and configuration of the Rental Premises in as/is where/is condition and accepts full financial responsibility per this agreement. If for any reason Tenant considers the Unit as not acceptable, Tenant must notify the Manager immediately, so Manager can attempt to remedy the situation to Tenant's satisfaction. CHECK OUT: By 11:00 am. A later check-out may be exceptionally granted at an extra cost but only if these two conditions are met: 1. there is no new arrival checking into the property on the day of tenant's departure and 2. the request for a late check-out is made within twenty-four hours prior to the check-out date stated on the agreement. Charges for a late check-out not timely requested will be made against your security deposit for a minimum of the total cleaning fee charge stated on your agreement and a maximum of the nightly rental fee. Please leave all keys, garage openers and such at the location. A $50 per item fee will be charged for each lost key and remote control. CLEANING: The property will be inspected and cleaned after your departure. The cleaning fee you have paid will cover this. You are required to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit at the rate of $25 per hour. •Additional weekly/biweekly cleaning will be charged for stays over 10 days. A cleaning rate of $140 per cleaning will be added per week/bi-weekly and cleanings will be arranged weekly/biweekly to accommodate guests schedules. TENANT'S LIABILITY: Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenants guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse owners for costs incurred to repair/replace damaged items. HOLD HARMLESS: Owner(s) / Manager(s) do not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, phone, internet, cable or satellite TV, or electricity services or plumbing. Nor will Owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control. The foregoing notwithstanding, Owner(s)/Manager(s) will use good faith efforts to remedy any deficient condition following notice. POOL, SPA and WALKWAYS: The undersigned is fully aware that these can be dangerous, that the walkways and area around the pool and spa can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the walkways. ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from, provided however, that Owner(s)/Manager(s) shall remain liable for such damages to the extent that such damages are determined to be the direct result of Owner(s)/Manager(s) negligence. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. PERSONAL PROPERTY LEFT BEHIND: If found, any items left behind will be mailed back upon request via USPS. The cost of shipping, shipping container and any packing materials will be deducted from the security deposit along with a handling fee. TENANT AS SUBJECT OF THE LAW: Tenant acknowledges that during the length of the rental period, Tenant and his/her guests is/are subject to all State and Federal laws, County Ordinances and City regulations valid within the jurisdiction where the Unit is located. Owner(s) and/or Manager(s) are neither responsible to inform Tenant of what these laws, ordinances and city regulations are, nor could Owner(s) and/or Manager be held liable should Tenant(s) and/or Tenant's guests commit a crime, misdemeanor, felony or infraction (including parking infractions). UTILITIES: On stays of 25 nights or greater, Tenant is responsible for actual gas and electric consumption charges, including those resulting from pool/spa heating where applicable. The amount to be charged will be calculated based on the reading of the meters upon check-in and check-out. Should an actual meter reading not be possible, Manager reserves the right to estimate the charges based in historical records. Utility charges will be discounted from the security deposit unless otherwise agreed. If at any time during the Tenant's stay the amount to be charged for utilities exceeds the amount held as security deposit, Tenant agrees to pay the amount immediately as requested or have the amount held as security deposit increased accordingly. Air Conditioning equipment, during the months of May through October, consumption of gas and electric up to $25.00 / day is included. Where applicable and whenever pool/spa heating is requested, this service will be charged separately at $50/night or the rate indicated in the reservation summary. You must also acknowledge Security Deposit - if you damage the home, you may be charged up to $2000 ***TOILET*** DO NOT THROW ANYTHING BUT TOILET PAPER INTO THE TOILETS. All other garbage (i.e. Tampons, baby wipes, paper towels, etc) is to go into the waste basket. •Please DO NOT bring glasses in or around the pool or spa. There are plastic glasses provided for pool and spa use. •Please DO NOT leave any flammables such as candles, incense unattended. •Missing and/or stained TOWELS will be charged to the guest at a rate of $25 per item. ANY BROKEN OR MISSING ITEMS will be charged to the guest accordingly.
